- Definitions
- “We”, “Us”, “Company” means Port Stone Landscape LTD registered company number 14839274
- “Customer” defines the person purchasing the Goods and services from us.
- “Goods” means the products you are ordering from our website
- “Services” means the use of the company
- “Writing” means in writing and sent to our registered office and does not include email.
- “Registered Office” means the office which our company, Port Stone Landscape LTD Llys Deri, Carmarthen, SA31 2NF is registered to.
- “Acceptance” an email / form sent to you at the email / postal address you provide in your order form or verbal acceptance by telephone.
- “Split pallet” means any pallet that’s made to bespoke SQM / pieces that are less than the full pack pallet.
- Policy
These Terms and Conditions constitute a legally binding agreement made between the customer, whether personally or on behalf of an entity (“the customer”), and the company, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Terms and Conditions.
The company reserves the right, in their sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. The company will alert the customer about any changes by updating the “Last updated” date of these Terms and Conditions. It is the customers responsibility to periodically review these Terms and Conditions to stay informed of updates. The customer will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by their continued use of the services after the date such revised Terms and Conditions are posted.
We recommend that you print a copy of these Terms and Conditions for your records.
- Prices, Quotations, Estimates
Prices, quotations and estimates are set by the company with good integrity and are based upon current information at the time of purchase. Prices of materials changes frequently which is outside of the control of the company, and the company reserves the right to alter prices accordingly without notice. Quotations and estimates are valid for 14 days from the date of which they are provided. The customer is liable for any additional taxes and/or fees.
- Delivery
The company uses reputable third party delivery couriers. The company is not liable for any damages whereby accidental damage occurs whilst unloading or handling the goods on site. If in any event this does occur, the customer is liable to record the incident, refuse the delivery if they are not satisfied and notify the company within 24 hours of the delivery. It is the customers responsibility to quality check the product prior to signing for the delivery. If the customer receives a damaged delivery and chooses to accepts the delivery they must sign the goods as ‘damaged’. On delivery day, the customer must be present to sign for the delivery. Failure to provide a signature will result in the goods being returned and the cost liable to the customer.
The customer is liable for ensuring the delivery address specified at time of purchase is accurate, and you must provide any additional information required to ensure the courier can successfully deliver to the given address. The customer is liable for ensuring that the site specified for delivery is adequate, which includes but is not limited to adequacy of access and space, level and firm ground for a pump truck trolley. The customer will be liable for any additional costs if for any reason the customer delays the courier for an unreasonable amount of time during the delivery process. In the event of a customer failing to ensure the accuracy of site address and inadequacy for delivery, the company reserves the right to retain the delivery fee, any additional charge incurred by the courier for the journey and return the goods to the depot.
The company endeavours to unload the goods at the desired location of the customer, however if this is not possible the courier will place the pallet at the nearest most acceptable area of the delivery address. If the delivery is unloaded and positioned on a kerb the customer is liable for any permits and/or other fees associated with the positioning of the delivery outside of the curtilage of the delivery address. The company is not liable for any damages incurred to your private property at the time of delivery. The company is not liable for any arrangements made between the customer and the courier. You are responsible for your safety during the unloading and delivery process, the company will not take any responsibility for any harm or injury incurred during this process.
Every attempt will be made to deliver the goods within 30 days of purchase, however we are not bound by these time frames. If for any reason the goods are unable to be delivered due to the customers shortcoming, the courier will reattempt delivery. Any additional charges for redelivery, storage and time will be liable to the customer.
- Damages
As above, the customer is liable for inspecting the goods at time of delivery. If the customer is not satisfied with the goods once they have arrived, for reasons such as any damages or faults with the product, or if they are defective in any way, or if there is incorrect quantity the customer must refuse the delivery. The customer must notify the company as soon as possible and within 24 hours of delivery should this occur.
It is at the forefront of the company to ensure we supply products in perfect condition upon delivery, however on rare occasions a minority of the goods may be damaged during transit whilst with the courier. When the customer places their order they must allow an additional 10% of product to ensure they account for potential breakages, cuts etc for their project. If there is less than 7.5% damage to the delivered product, the company will not offer refunds nor replacements as this is our tolerance level and is accounted for within the price of the product. However, if there is more than 7.5% damage, we will refund for the difference of the product damaged over our tolerance level, only if the product is marked as damaged on delivery.
The company is not liable for any damage occurred to the product once the product has been unpacked and altered by the customer in any way such as, but not limited to, cutting the goods, your negligence, affixing the goods to any land or buildings, storing the goods, relocating the goods from delivery point and failure to use best practice methods in relation to the particular goods.
The customer must notify the company of any damages as soon as possible and within 24 hours of receipt of the goods. The customer must notify the company in writing and provide photographic evidence of the damage via email to [email protected]
The company cannot take forward any disputes relating to damaged products or incorrect quantity if the delivery has been signed for and no contact has been made with the company within a 24hour period from the time of delivery.
- Warranty
The company offers warranty on all products from the date of sale. The company offers a 5 year warranty on porcelain products and a 2 year warranty on natural stone products. All other products advertised and sold by the company will be subject to the product manufacturers warranty. However the company is not liable for any damages such as but not limited to, fair wear and tear, negligence, accidental damage, power washing, application of any chemical cleaning or sealant products, poor or incorrect instillation, sub-base movement, movement expansion, impact damage, defects or damages caused by weather conditions, misuse of the products, any use other than domestic.
Any claims must be raised via email to the company with photographic evidence attached to allow the company to liaise effectively with the manufacturer. If the defects are covered by the warranty the company will cover the cost of the assessment and replace the defective product, however if the defects are not covered under the warranty the customer will be liable to pay any fees associated with the assessment.
Some products are produced via natural materials and therefore there may have a colour and texture variation between products and weathering processes may alter the product over time. The company is not liable for ensuring each item is identical for this reason. Further to the above, samples and photographs are provided as an indication only. Such differences will not warrant a refund by the company.
- Returns
The customer is responsible for ensuring the choice of product is suitable for their project and must take into account any possibilities of shade and texture variations which may differ from our website photos/samples.
The company can only offer returns on products that are unused, in their original packaging, and in the same condition as they arrived. The return must be raised within 14 days of delivery. The customer must ensure the product is packaged secure for the return journey and they are accountable for organising and covering the cost of the return. The customer is liable for any damages that may occur in transit. Additionally, the customer is liable for a 15% restocking charge for any returns made. The cost for the original delivery charge for the goods is not eligible for a refund, these deductions will be taken from the total refund accordingly. The refund will be processed and made back to the original payment method within 30 days from the date the goods have arrived at the company depot and have been inspected by the company to our satisfaction.
- Collections
Some products will be available for collection which will be reflected in a reduced price on the listing. “Collection price” will be advertised in the listing of the product on the website. Delivery may be available at an additional charge to the listing price of these products. The company will confirm in writing the logistics, date and time for collection and if delivery is possible the charge for this.
- Events beyond our control
The company endeavours to do our utmost to successfully fulfil each order, however it is not liable for events beyond our control which result in failure, delays, defects or damages associated with delivering products to the customer. Such circumstances include but are not limited to strikes, natural disasters, inclement weather conditions, industrial disputes, mechanical breakdowns etc.
- Cancellation of orders
Quantity, pricing and availability of stock fluctuates regularly with short notice. The company reserves the right to cancel any orders should there be insufficient stock to fulfil the order. The company reserves the right to cancel orders should there be an error in the cost or quantity of the listing, or if we do not deliver to the customers location. The company reserves the right to cancel if the supply chain for the goods is interrupted for any reason and we cannot fulfil the order. If the company cancels an order, they will inform the customer via email and process a refund as soon as possible. The company is not required to compensate for any of these eventualities.
- Copyright and content usage
The company’s publications on all formats are the exclusive ownership and property of the company. The use and copy of the company’s publications must be obtained via prior written approval of the company. The company reserves the right to request the withdrawal of any content copied from the companies website and any of the company’s social media platforms without prior written approval. The customer agrees to grant the company permission to use images and any other content produced from products which have been purchased from the company.
- Data protection
The customer agrees to allow the company to use their personal details in order to supply them with the goods which they have ordered, this includes sharing the customers details with employees of the company and third party agents such as but not limited to the courier company. The customers details will be shared internally to ensure that the company can fulfil the order by means of compliance, accounting and logistic purposes. The customers details will not be used nor shared for any other purpose than to ensure that the order is fully complete.
